While the provisions of the Data Protection Acts 1998 and 2003 are outside the scope of the Local Government Management Agency/Building Control Authority it is understood that they place clear limits on the use of publicly available data for marketing or other purposes. Any person who proposes to use such information in this way is considered to be a data controller for the purposes of the Data Protection Acts. Section 2(8) of the Data Protection Acts provides that where a data controller anticipates that personal data will be processed or used for the purposes of direct marketing, including personal data that is required by law to be made available to the public, the data controller shall inform the persons to whom the data relates so that they may object, by means of a request in writing to the data controller and free of charge, to such use.
Breaches of Data Protection legislation are a matter for the Data Protection Commissioner who has the power to investigate such matters and, where appropriate, prosecute offences under the Acts.

The breakdown of each block will contain the following apartments: • Block DCC1 comprises 111 No. apartments in a block of 6-7 storeys • Block DCC 3 comprises 247 No. apartments in a block of 6-15 storeys • Block DCC5 comprises 132 No. apartments in a block of 2-7 storey • Block DCC6 comprises 53 No. apartments in a block of 7 storeys This Commencement Notice relates to DCC6. The remaining blocks shall be subject to separate future FSC applications and commencement notices. DCC6 is made up of a single core containing 7 storeys of residential units and a communal roof terrace. All residential units provided with associated private balconies/terraces as shown on drawings. A communal courtyard will be provided at the ground floor and roof level. The apartments are approached by either a ventilated lobby or balcony approach as demonstrated on the enclosed drawings. All ancillary accommodation is located at ground floor and are accessed from atmosphere. The top floor height of the habitable accommodation is less than 20m.
