While the provisions of the Data Protection Acts 1998 and 2003 are outside the scope of the Local Government Management Agency/Building Control Authority it is understood that they place clear limits on the use of publicly available data for marketing or other purposes. Any person who proposes to use such information in this way is considered to be a data controller for the purposes of the Data Protection Acts. Section 2(8) of the Data Protection Acts provides that where a data controller anticipates that personal data will be processed or used for the purposes of direct marketing, including personal data that is required by law to be made available to the public, the data controller shall inform the persons to whom the data relates so that they may object, by means of a request in writing to the data controller and free of charge, to such use.
Breaches of Data Protection legislation are a matter for the Data Protection Commissioner who has the power to investigate such matters and, where appropriate, prosecute offences under the Acts.

The development consists of: -1) The demolition of the existing 3 storey red-brick commercial building at no. 126 Pembroke Road and 2 no. ancillary outbuildings (total gross floor area (GFA) of buildings to be demolished is c. 1,161 sqm); and 2) The construction of a mixed use development, in 3 no. blocks, ranging in height between 4 storeys and 11 storeys, all over a 4 level basement. The scheme will comprise of residential units; commercial floor space (comprising office, retail, cafe and cultural accommodation); and leisure floor space all to be provided as follows:- A) Block 1 (8 storeys plus plantroom) will comprise c. 2,854 sqm GFA of office accommodation; and 1 no. cafe/restaurant unit at ground floor level. Access to the basement levels will be off a two-storey ramp at Shelbourne Lane. E) All associated site development, landscaping and boundary treatment works including:- The provision of 2 no. public plazas and internal pedestrian streets at ground floor level which will run through the site between Pembroke Road and Shelbourne Road ( total area of plazas and streets is c. 2,2283 sqm); 3 no. roof gardens and 1 no. open air event space; and 1 no. landscaped courtyard at Basement Level -1 ( total area c. 1,645 sqm) 1 no. ESB substation is proposed at ground floor level within Block 2. The total GFA of the proposed development (above ground) is c. 32,708 sqm plus basement levels c. 26,494 sqm GFA. The above ground (superstructure) elements of the works commenced under a separate 7-Day notice and the superstructure of the above ground elements has been completed to roof level. This 7 day notice is now submitted in respect of the below ground areas of the development.
