While the provisions of the Data Protection Acts 1998 and 2003 are outside the scope of the Local Government Management Agency/Building Control Authority it is understood that they place clear limits on the use of publicly available data for marketing or other purposes. Any person who proposes to use such information in this way is considered to be a data controller for the purposes of the Data Protection Acts. Section 2(8) of the Data Protection Acts provides that where a data controller anticipates that personal data will be processed or used for the purposes of direct marketing, including personal data that is required by law to be made available to the public, the data controller shall inform the persons to whom the data relates so that they may object, by means of a request in writing to the data controller and free of charge, to such use.
Breaches of Data Protection legislation are a matter for the Data Protection Commissioner who has the power to investigate such matters and, where appropriate, prosecute offences under the Acts.

This level also accommodates the car parking area and bicycle storage area. Student accommodation units will be provided at upper ground floor and upper floors, Block E includes green roofs (287.2sqm) and roof terraces (290.1sqm) providing private open space. Block E will have a total of 178.8sqm in gross of office/retail/cafe/restaurant floorspace for use by Digital Hub at upper ground floor level, 23 no. car parking spaces are to be provided within a surface car parking area located to the west of the site at lower ground level 54 no. bicycle spaces are to be provided at lower ground floor level in Block E. Access to car park will be from Bonham Street. 94 no. bicycle spaces are provided at surface level adjacent to Blocks E . A new pedestrian link from Bonham Street known as Roes Lane terminating in a new public space known as Roes Place. A new 582.2 sqm landscaped open space is also to be provided to the west of Block E at upper ground level. The development includes internal switch and sub stations; all site development works, landscaping, waste management facilities and all other ancillary works.
